Benefits of a Revocable Living Trust

There are benefits to creating a Revocable Living Trust Estate Plan vs a tradition will or having no plan at all:

  1. Privacy.  If your Trust is fully funded, meaning no assets are remaining that will need to go through probate, your estate could avoid probate altogether.  Probate records are public, thus everyone would be privy to the details of your estate.

  2. Continuity of Management.  If you become incapacitated, your assets will continue to be managed by the Trust Agreement and will not be hindered by any potential delays such as a conservatorship/guardianship proceedings.

  3. Availability upon Death.  Similarly, the assets of the Trust will pass almost instantaneously upon death.  This will allow your beneficiaries to benefit from the Trust without undue delay or lengthy Court involvement.

  4. Peace of Mind.  A Trust allows you to direct your Estate now instead of leaving it via a will and probate.  Although a Trust can be subject to attack or contested from individuals, a Trust is typically contested significantly less often than a Will, for various reasons but most importantly, the formation of a lengthy Trust strongly evidences the Grantors intent for the direction of their assets in contrast to a short, simple will that is constructed in a hurried fashion.
