What documents will I need in order to file bankruptcy?

Before you file a Chapter 7 or Chapter 13 bankruptcy, there are a few documents you will need to gather. This can vary slightly, depending on your jurisdiction and Trustee requirements but most are very similar.

  1. Driver's license. You will need to provide your Driver's license.

  2. Social Security Card. If you cannot find your social security card, you can get a new one printed at your local social security office.

  3. Proof of income. You will need your paystubs for the last 6 months to show proof of how much you are earning.

  4. Tax returns. You will need the last 2 years of your tax returns.

  5. Bank statement. Recent 30-day bank statements for each account that your list in your Petition.

  6. List of creditors. You will need to provide a list of all of your creditors - names, addresses, amounts, and account numbers. Most attorneys will have a way to run your credit report but it is a good idea to also make your own list before you go because sometimes certain creditors do not report to your credit report.

  7. Expenses. A list of your current monthly expenses for items you pay for each month such as rent, mortgage, utilities, cell phones, tv, internet, any insurances, etc.
